DALLAS, Mar. 7, 2019 /PRNewswire-PRWeb/ -- Terri DeNeui, Dan DeNeui, Evexias Health Solutions, Farmakeio, Farmakeio Outsourcing, and others are named in a Racketeer Influenced and Corrupt Organizations (RICO) Act and Lanham Act lawsuit in the United States District Court for the Eastern District of Texas, Sherman Division.

In the Complaint Case Number 4:18-cv-00866-ALM, BioTe® alleges that wife and husband Terri and Dan DeNeui, among others, "aggressively sought to bolster their revenue, increase profit and grow their share of the Bio-identical Hormone Therapy Market by unlawfully paying … kickbacks and bribes, misrepresenting their certifications and qualifications and that of their product, and illegally supplying unapproved formulations of their hormone therapy pellets to medical providers for distribution to patients, among a myriad of other allegations."

The Complaint further alleges that "the defendants are engaged in pernicious, illegal, and extensive enterprise to manufacture, market, sell and distribute illegal drugs throughout the United States. While undeniably less violent than the drug cartels infiltrating the U.S., the defendants illegally distributed their products … to sell their drugs to unsuspecting and trusting patients which presents a potentially greater health hazard than the cartels, whose products are distributed and sold through openly criminal means."

The lawsuit seeks, in addition to damages, to enjoin the defendants from "illegally manufacturing, marketing and distributing the Evexias Hormone Pellets (which have not undergone the drug approval process) and misleading doctors and patients about the lawfulness of their business." A preliminary injunction hearing is set for May 30, 2019 in federal court in Sherman, Texas.
