The court has recognised that the current director, ayurved depatment, has been ex offcio made the state drug licensing authority, but the charge is formally under an officer of RAS cadre, who does not have the requisite knowledge of drugs, medicines and other matters.
"The firm challenged a notice issued by the state drug licensing authority whereby it was called upon to show cause as to why four firms are operating from the same premises where the firm has been registered. But the licensing authority is the director, ayurved department who is a Rajasthan Administrative Service officer, whereas under the law a person having qualification in siddha, or unani or ayurveda course can only act as the licensing authority," argued B B Pareek, counsel for the petitioner.
