Rapist Father Fails to Get Hearing in Indian Supreme Court

The Supreme Court on Friday refused to hear an appeal from a man convicted to life term for repeatedly raping his minor daughter who was living with him after his estrangement with his wife.

A bench comprising Justices Arijit Pasayat and P Sathasivam would not even contemplate issuing notice to the state of Rajasthan from where the petitioner hails. The judges said they were disgusted by the facts of the case and held that the judgments rendered by the trial court and the state High Court in the case were impeccable.

The over 50-year-old Hanuman Singh was married to Shanti Devi for 35 years and had two sons and two daughters, the elder of whom was 16 years old.

Shanti, unable to endure her husband's daily assaults, had in 1999 decided to leave her husband's house in Ajmer and live with her brother, but her children stayed with the father.

When in September 2000 to meet the children she visited her children, the elder daughter started crying and insisted on being taken away from there . Once she reached her uncle's place, the girl narrated her tale of being repeatedly raped by her father for the previous six months.

The father used to threaten her and also emotionally blackmail her on the ground that if she complained, he would lose his job and that her other brothers and sister would starve. The mother complained to the police, which registered an FIR. Medical examination proved sexual assault. The father took the defence that false charges were being foisted on him at the behest of his estranged wife.

He also questioned the veracity of his daughter's complaint on the ground that she had never ever told her grandmother or other siblings. Moreover, he had pleaded that the trial court should not believe the singular statement of the victim without any corroborative evidence.

Rejecting the argument, the HC had said it was natural for a minor girl, undergoing the harrowing experience at the hands of her father, to not to tell anyone about it till she found her mother to confide in.
